The COVID-19 pandemic has brought new challenges to the workers’ compensation landscape, both in how administrative hearings are conducted and how we view the issue of compensable occupational diseases. Ohio employers of all sizes have serious, and somewhat unprecedented, issues to consider in the administration of their workers’ compensation programs. While there is no way to prevent employees who contract COVID-19 from filing workers’ compensation claims, it is challenging under the current law for most employees to establish a compensable occupational disease claim. As of early January 2021, there have been 2,832 COVID-19 claims filed—1,850 of them within the healthcare industry alone. Since March 2020, however, the Industrial Commission of Ohio has been conducting hearings via telephone at a reduced frequency, only recently addressing the resulting backlog of hearings. So, it is likely that these numbers will increase drastically in the coming months and we should see many flu season coronavirus claims come to hearing between now and May, particularly in the healthcare field. For that reason, discussing the issue of COVID-19 and workers’ compensation is uniquely timely and crucial to healthcare providers and professionals.
